The difference between legal and ethical is that all things legal have relations to the law, therefore if we cross this legal boundary this would result in a consequence like getting fined or jailed. How this relates to my music video, is that by using the musicians and any actors that may be used, all must sign a release and consent form which would mean that they have signed their name in agreement that they want to be shown in the video this is because they own their rights for their intellectual property. Without a release and consent form, this could result in musicians or actors to file a complaint which could end in a legal dispute depending on what is being concerned with what the musicians / actors fine a complain against. Another potential issue is that if I don't have legal rights to use 'Million Thing' by 'The Stoops' due to it being their intellectual property, this means that there should be a signed contract between me and the band so that the song an be used for this production. If this signed contract doesn't happen, this could result in a repercussion. Another potential issue applies if i want to use their logo for the introduction of their music video. I would need permission as this is something that they hold intellectual property rights to but along side this - this falls under the copyright, designs and patents act because it means that the creators (The Stoops) can instruct others into how their music is used. This is important because it prevents the bands music from being used in ways in which they dont want it to be used. Another legal issue is The Stoops have their own logo for their band name - this means that they have their own Intellectual property rights over this which means that permission needs to be gained in order for it to be used in the music video. Permission needs to be gained by the artists as this means that i can creatively incorporate their logo in the music video.
A regulator who would be rating the age of the music video would be the BBFC, The British Board Of Film Classification. The music video would be getting an age rating based on how appropriate the content is or a parental advisory warning will be shown beforehand. How to enable to make the content available for all is to make sure no explicit content is being used, that there is no strong language or graphic scenes. My music video would be certificated a PG, due to wanting it to be available for all audiences. This means that there won't be a parental advisory warning at the beginning of the video due to there being no reason for audiences to be pre-cautious towards the imagery ahead. OfCOM would be the regulator who would be circulating the TV for all the content that gets put out and whether that its suitable for a certain channel - or if its suitable for being shown on TV at all. The music video will most likely be shown on a music channel like MTV as this is the purpose of such channels. However the target audience being 16-25 year olds, this means that if explicit content were to be used - the age rating could be certificated a 15 thus being able to gained access by the target audience. Therefore not effecting the chosen demographic.
